Terms and Conditions TERNAVSKI snow academy

Welcome to the website of TERNAVSKI s.r.o. , Jazzová 185/6, Poprad 058 01, CRN: 57 160 601, TIN: 2122593242 (hereinafter referred to as TERNAVSKI). By continuing to browse and view our website www.ternavski.sk, you agree to our terms and conditions (TC) and all website terms and conditions and personal data protection regulations. If you do not agree with any of our terms and conditions or legal provisions in these TC, please do not use our website or contact us at ternavski@ternavski.sk. We reserve the right to change our TC and privacy policy at any time. Changes and explanations will take effect immediately after their publication on the website.

Insurance
TERNAVSKI is not responsible for insuring clients. Lessons do not include insurance.
TERNAVSKI declines any responsibility for accidents, injuries, and losses during lessons or their consequences. We strongly recommend that our clients purchase travel insurance or other suitable insurance for skiing, such as mountain, accident, health, rescue, or recreational insurance. From June 1, 2020, every visitor staying in the High Tatras and registered in the register of accommodated persons from whom accommodation tax has been collected is collectively insured for Mountain Rescue Service (HZS) intervention. Prices and lesson times
Prices for school services (ski or snowboard lessons) are valid according to the current price list on the school’s website, specifically on the page Lesson price list. Lesson times are listed in the price list including breaks of 5, 10, or 20 minutes, depending on the type and duration of the lesson.

Lesson participants
Lesson participants are persons registered for the lesson and may be children, teenagers, or adults, for whom you only need to specify the age group: Children under 6 years of age, Children under 10 years of age, or Other Persons aged 10 years and older.
The person paying for the lesson is the Customer and must indicate whether he/she “is” or “is not” a participant in the lesson. If they are, this will be indicated on the form and in that case all the Rules for Participants (see below) will apply to them, or if they are not, they will register another person or persons, the participants in the lesson, for the lesson.

Skiing level and difficulty of slopes
We use three colors to indicate the difficulty of the slopes and the skiing level of the students, following the example of the Swiss Snowsports school: blue–red–black, which is based on the international system of classification of skiing abilities and has been adopted by most ski resorts in Europe. Especially for the needs of our school, we have added the term “First Timer” to describe beginners, especially children who are skiing for the first time. In our BS, we use four levels for classification. Click on the link Four skiing levels.

Rules for lesson participants
In accordance with the current methodology of teaching skiing and snowboarding recommended by accredited educational organizations (ZSL, SAPUL, and others), we adhere to the rules for teaching children and other persons (hereinafter referred to as the “Rules”) who enter the teaching process. The customer is responsible for putting together and selecting participants for the group so that the Rules are followed.
  1. Children making their first turns on the snow, first-timers under the age of 10, must have a private solo lesson (the total number of people must be set to “1“).
  2. Only children under 10 years of age, beginners and intermediate skiers, up to a maximum of 3 people (no teenagers or adults) can learn together in a children’s group.
  3. The group requires the same skiing level of participants (see article above).
The basic rules of our school apply: • In a mixed-age group aged 10 and above (teenagers and adults), the total number of participants may be a maximum of 4 people • In each group, the first participant is the Main Person, the other participants are Additional Persons (the number of which may be limited when applying a specific Rule) • The customer is responsible for correctly filling out the registration form, which is in the reservation system 1 step before the advance payment • A deliberately or incorrectly filled out form, or a form that does not comply with the Rules, is invalid and the school has the right to reject such a reservation.

Reservations and payments
Customers can book lessons through our online Booking System (BS) at the link Bookings (recommended). We are constantly developing and improving our BS with new features, the latest being the addition of a Booking Cart. When using the Cart, it is important to know that when purchasing lessons for the Cart, the number of participants in each lesson in the Cart must be the same (constant). In other words, one purchase for the Cart is only possible for one and the same group of people. Furthermore, all Rules for Lesson Participants according to the article above.
Orders can also be placed via the online registration form at the link Lesson form, or by phone at +421 905 903 058. The latter two options, including various agencies or websites, do not guarantee that your desired date will be available, so we recommend using the first option, our BS. All lessons must be paid in advance, as a deposit, in the amount of 50% of the total price for the lesson(s) at the time of booking. The remaining portion of the price will be paid on site in cash. We accept transfers via the STRIPE payment gateway. We support almost all types of credit and debit cards (including Visa, Mastercard, Maestro, etc.). In addition, Stripe also supports transfers from the Stripe account back to the customer’s account in cases of justified refunds. Bank transfers are made to our account in euros. Transfers are made on a daily basis, but the transfer time to your account may take a few days longer (5 to 10 days). The reservation will not be confirmed until the advance payment has been received.

Cancellation
Cancellation of a reservation will be charged as follows:
  • less than 3 days 50% of the total price for lessons (the advance payment is non-refundable)
  • less than 14 days 25% of the total price for lessons (half of the advance payment will be refunded)
  • more than 14 days full refund of the advance payment
Our instructors work in all weather conditions that they consider acceptable for lessons. In the event that we cancel a lesson due to adverse weather conditions, mechanical failure, or any other reason beyond our control, TERNAVSKI will refund 80% of the advance payment for the lesson(s). TERNAVSKI will not refund (return) money in the event of illness (except with a doctor’s note), bad weather conditions, or partial closure of the ski area.

Punctuality and notifications
Why we require punctuality: Once the reservation is confirmed, the instructor is “booked” for only one specific client and is paid for the lesson, from the start of the lesson. Punctuality and arrival at the meeting point are required, and in case of late arrival, the advance payment is non-refundable and the client is obliged to pay the remaining price for the lesson in cash.
Start of the lesson: instructors will wait a maximum of 50 minutes at the meeting place after the scheduled time. Customers who have booked a lesson through BS will also receive a notification of the time and details of their lesson in their email inbox. The email address is mandatory information that the customer provides for their menu as a unique identifier (multiple email addresses cannot be used for one menu and customer surname). A phone number is also mandatory, as we may contact you at any time before or during the lesson to finalize details or find out the reason for your absence. Therefore, please be available during the lesson.

Children’s lessons
Our lessons are private, but you can create smaller groups of up to 4 people, while complying with the Rules for creating children’s groups (see above).
At the beginning of the children’s lessons, we will check the children’s skiing level. If necessary, we may move children between groups to ensure that the lessons run smoothly. Accordingly, we may need to change the size of your group. This may mean that the group will be divided into two or more smaller groups in accordance with the Rules. All our lessons require a minimum of 1 person to run smoothly. We reserve the right to cancel or adjust the number of children in a group, or to adjust the times if the Rules for the recommended number of children are not followed. If you are the only person booked for a lesson, we will contact you at least one week before the lesson to discuss your options: 1. You can cancel the lesson and receive a full refund. 2. You can transfer your booked lessons to another person. 3. You can reschedule your appointments within 7 days of the start date of the lesson. We will never contact registered participants other than the customer and will not request any additional personal information from them. The customer (the person paying) is responsible for the registered participants.
In order to provide high-quality lessons in a safe environment, we will only collect necessary information about participants, such as: children’s ages, skill levels, health conditions, learning difficulties, or special requirements, and only for teaching purposes.
Children must wear appropriate ski clothing, sunglasses or ski goggles, and use other appropriate ski equipment (ski or snowboard skis, bindings, boots, poles, etc.) during our lessons. The equipment is either their own or rented from a rental shop near the meeting point.
Children must be able to use the toilet without assistance.
Children under the age of 10, as well as other persons, must wear a protective helmet at all times while skiing during lessons.
A fee of €30 will be charged for late pick-up of children. Fees for non-pickup will apply 15 minutes after the end of the lesson.

Photography
During your lessons, we may take photos and videos of clients, including children under the age of 18, for coaching and marketing purposes.
If you do not want us to use images or footage of you or your children, please let us know when you make your reservation. Please include this in the comments section of your reservation and inform the instructor.

Equipment
We are not responsible for equipment brought by clients or equipment from rental shops. You can rent equipment from our contractual partners at our contractual prices, which are listed in the price list (we will give you a printed seasonal brochure with the price list and times at the cash desk).

Ski courses
These general terms and conditions apply to private skiing and snowboarding lessons and do not apply in full to organized ski courses. Ski courses are governed by the general regulations of the Ministry of Education and the internal regulations of ski resort and ski lift operators for group ski courses. When you book a course, we will contact you in advance to discuss all the conditions for your course. You can book your course in advance via our website by filling out the online form at the link Ski course form. After receiving the form, we will check if your date is available, suggest a schedule, divide participants into groups, and finalize the details of your course.

Jurisdiction
TERNAVSKI snow academy is a private Slovak company, and Slovak law applies in all circumstances. The place of jurisdiction is Poprad, Slovakia.
